The confidentiality obligations set forth in this section shall survive the termination or expiration of any service agreement for a period of five years, or indefinitely with respect to trade secrets and other information that derives independent economic value from not being generally known.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Mo Thu Solutions and Tay Mo Thu Cong Inc., including their respective officers, directors, employees, agents, contractors, and affiliates, shall not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or reliance damages of any kind, including but not limited to loss of profits, loss of revenue, loss of business, loss of data, business interruption, cost of substitute services, or loss of goodwill, arising out of or in connection with these Terms of Service, the use of our website, or the provision of our professional services, regardless of the legal theory under which such damages are sought, whether in contract, tort (including negligence), strict liability, or otherwise, even if we have been advised of the possibility of such damages.

11.2 Termination by Us

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms of Service and any disputes arising out of or relating to them shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.

12.2 Dispute Resolution

If the parties are unable to resolve the dispute through negotiation within thirty days, either party may refer the matter to mediation administered by a recognized mediation service in Toronto, Ontario, Canada.

12.3 Class Action Waiver

Neither you nor Mo Thu Solutions will seek to have any dispute heard as a class action, private attorney general action, or in any other proceeding in which either party acts or proposes to act in a representative capacity. No arbitration or proceeding will be combined with another without the prior written consent of all parties to all affected arbitrations or proceedings.

13. Force Majeure

Neither party shall be liable for any failure or delay in the performance of its obligations under these Terms of Service or any service agreement to the extent such failure or delay is caused by circumstances beyond the party's reasonable control, including but not limited to acts of God, natural disasters, fire, flood, earthquake, epidemic or pandemic, war, terrorism, civil unrest, riot, labor strike or other industrial disturbance, governmental action, embargo, utility or telecommunications failure, cyber attack, Internet service provider failure or delay, or other events of force majeure.

The affected party shall notify the other party promptly of the occurrence of a force majeure event and shall use commercially reasonable efforts to mitigate the effects and resume performance as soon as reasonably practicable. If a force majeure event continues for more than thirty days, either party may terminate the affected service engagement upon written notice without liability for such termination.

14. General Provisions

14.1 Entire Agreement

These Terms of Service, together with our Privacy Policy and any applicable service agreement or statement of work, constitute the entire agreement between you and Mo Thu Solutions regarding your use of our website and services, superseding all prior or contemporaneous communications, agreements, and understandings, whether written or oral.

14.2 Severability
